Acceptance of Terms

By accessing and using the inovex B.V. website (inovex.world) and engaging our construction and contracting services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our website and services. Services Description

inovex provides professional construction and general contracting services including but not limited to residential construction, commercial building projects, renovation and remodeling services, design consultation, project management, and related construction activities. All services are provided in accordance with Dutch building codes, regulations, and industry standards. Specific terms for individual projects will be outlined in separate service agreements or contracts.

Website Usage

You may use our website for lawful purposes only. You agree not to use the website in any way that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use of the website. You may not attempt to gain unauthorised access to any services, user accounts, computer systems, or networks through hacking, password mining, or any other means. You agree not to use automated systems or software to extract data from our website for commercial purposes.

Quotations and Estimates

All quotations and estimates provided by inovex are valid for 30 days from the date of issue unless otherwise specified. Quotes are based on the information provided by the client and may be subject to change if project specifications are modified. Final pricing will be confirmed in a detailed contract before work commences. We reserve the right to adjust pricing for unforeseen circumstances, changes in material costs, or modifications to the original scope of work.

Payment Terms

Payment terms for construction services will be specified in individual project contracts. Generally, we require a deposit before work commences, with progress payments due at agreed milestones, and final payment upon project completion and client acceptance. All payments must be made in Euros. Late payments may incur interest charges as permitted by Dutch law. We reserve the right to suspend work if payments become overdue.

Project Timeline and Completion

Project timelines are estimates based on normal working conditions and are subject to factors beyond our control including weather conditions, permit approvals, material availability, and client-requested changes. While we strive to complete projects on schedule, inovex shall not be liable for delays caused by circumstances beyond our reasonable control. Any significant delays will be communicated promptly to the client with revised completion estimates.

Intellectual Property

The content on this website, including text, graphics, logos, images, and software, is the property of inovex B.V. and is protected by Dutch and international copyright laws. You may not reproduce, distribute, or create derivative works from any content on this website without our express written permission. Our company name, logo, and service marks are trademarks of inovex B.V. and may not be used without permission. Any original designs, plans, or creative works developed by inovex for client projects remain our intellectual property unless otherwise agreed in writing.

Warranties and Guarantees

inovex provides warranties on our workmanship as specified in individual project contracts, typically ranging from one to five years depending on the type of work performed. We warrant that our work will be free from defects in materials and workmanship under normal use. This warranty does not cover damage resulting from normal wear and tear, misuse, accidents, or modifications made by others. Our warranty obligations are limited to repair or replacement of defective work at our discretion.

Limitation of Liability

To the maximum extent permitted by Dutch law, inovex B.V.'s total liability for any claims arising from our services or this website shall not exceed the total amount paid by the client for the specific project or service in question. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. This limitation applies regardless of the theory of liability, whether based on warranty, contract, tort, or any other legal theory.

Insurance and Indemnification

inovex maintains appropriate professional liability insurance and general liability coverage for our construction activities. Clients are responsible for ensuring their own property insurance covers the project during construction. You agree to indemnify and hold harmless inovex from any claims, damages, or expenses arising from your failure to comply with applicable laws, regulations, or permit requirements, or from any modifications you make to our completed work.

Termination

Either party may terminate a construction contract with written notice as specified in the individual project agreement. In case of termination, the client shall pay for all work completed and materials ordered up to the termination date. inovex reserves the right to terminate services immediately if the client fails to make required payments or breaches any material term of the agreement. We may also terminate or restrict access to our website at any time without notice for violation of these terms.

Force Majeure

inovex shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, labour disputes, government regulations, or other unforeseeable circumstances. In such events, we will make reasonable efforts to minimise delays and will communicate with clients about revised timelines and any necessary adjustments to project terms.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which forms part of these Terms of Service. By using our website and services, you consent to the collection and use of your information as described in our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and applicable Dutch privacy laws in all our data processing activities.
